Ravinder Saimbhi successfully concluded a long running rape case this week at Wolverhampton Crown Court with a Not Guilty verdict finally being entered against her client, WD.
WD was accused of Rape in November 2018. He was 18 years old. As a result of the delays in the CJS, his trial did not take place until October 2021. The jury were hung and a retrial ordered.
The retrial took place and again resulted in a hung jury after over 15 hours of deliberation.
The prosecution then reviewed the case and did not pursue any further retrial, formally offering no evidence against him.
The case involved the single issue of consent but involved s41 and s78 applications concerning cross examination on sexual behaviour and to exclude evidence .
WD, now aged 22 was delighted and relieved at the outcome, finally able to move on with his life after a stressful 4 years of uncertainty.
