Milad Shojaei, instructed by Rabina Ditta from BKP Solicitors, secured a positive outcome at Oxford Crown Court. The case initially involved multiple charges, but pleas were accepted for Control and Coercive Behaviour and ABH on the second day of the trial. The facts of the Control and Coercive offence were severe, involving multiple violent incidents spanning a three-year period, alongside financial and emotional abuse, and explicit threats.
Compounded by the defendant contacting the victim hundreds of times while in custody, the offence carried a 1–4-year imprisonment range. Facing the possibility of the highest sentence and consecutive terms, Milad Shojaei's persuasive mitigation proved instrumental.
The judge, taking into account submissions on the issue of overcrowding in prisons, the defendant's mental health and a compelling set of character references advised by Milad, deviated from the expected course, citing exceptional circumstances and imposed a community order.
