Successful Representation by Milad Shojaei in Published Fact-Finding Case: NT v PM [2024] EWFC 263 (B)

Judgment was handed down on 5 June 2024 in the case of NT v PM [2024] EWFC 263 (B), where Milad Shojaei successfully represented the father in a fact-finding hearing involving serious allegations made by the mother.

The mother accused the father of a sustained campaign of sexual abuse, including marital rape and coerced abortions. Milad Shojaei robustly challenged these claims, and the allegations were ultimately rejected by the court. Additionally, Milad proved that the mother had engaged in emotional abuse by committing acts of revenge porn against the father.

In the judgment, District Judge Richmond highlighted Milad’s effective cross-examination, noting at paragraph 40:

"As Mr Shojaei tried to point out in cross-examination, it is emotional abuse, and he put to the mother, 'How would you feel if the father had put a secret camera or recording device in your car, and recorded you?' I am not sure that we ever got a sensible answer to that question, but it is patently obvious that anybody who was in that situation would feel abused."

It was submitted on behalf of the father that a psychological assessment of the mother was necessary given her approach to the proceedings and the threats she had made against the father. At paragraph 41, District Judge Richmond confirmed: 

"I do believe that there was certainly emotional abuse by the mother, and I think that fits in perhaps with my view of her reaction to stressful situations, the threats to commit suicide and so forth, but it is perhaps something which should be investigated through a psychological assessment."

This judgment, now published in the Case Law National Archives, serves as a significant outcome in the protection of parents facing false allegations and emotional abuse.
